MAILENDY ACCEPTABLE USE POLICY

1. PURPOSE

This Acceptable Use Policy (“AUP”) outlines the rules and standards governing the use of Mailendy services, systems, communication infrastructure, automation platforms, consulting services, and related technologies.

This policy exists to:

  • protect Mailendy’s infrastructure

  • maintain sender reputation

  • ensure legal compliance

  • safeguard client data

  • promote responsible communication practices

By using Mailendy services, clients agree to comply with this policy.


 

2. PERMITTED USE

Mailendy services may be used for legitimate business activities including:

  • customer communication

  • email marketing

  • customer retention

  • lead nurturing

  • customer relationship management

  • communication automation

  • customer support

  • business communications

All use must comply with applicable laws and regulations.


 

3. PROHIBITED ACTIVITIES

Clients may not use Mailendy services to engage in activities that are unlawful, deceptive, abusive, harmful, or unethical.

Prohibited activities include but are not limited to:

Spam

  • sending unsolicited bulk emails

  • sending communications without proper consent where required

  • excessive unsolicited outreach

  • email abuse

Fraudulent Activity

  • impersonation

  • phishing

  • identity theft

  • deceptive marketing

  • misleading communications

Illegal Activities

  • unlawful business activities

  • violations of applicable regulations

  • intellectual property infringement

Harmful Content

  • malware distribution

  • viruses

  • malicious code

  • harmful software


 

4. EMAIL MARKETING REQUIREMENTS

Clients using Mailendy email systems agree to:

  • use legally obtained contact lists

  • honor unsubscribe requests

  • maintain accurate sender information

  • avoid misleading subject lines

  • comply with applicable anti-spam laws

Mailendy reserves the right to suspend campaigns that may damage sender reputation or violate industry standards.


 

5. PURCHASED, SCRAPED OR THIRD-PARTY LISTS

Mailendy strongly discourages the use of:

  • scraped email databases

  • harvested contact lists

  • illegally acquired data

  • lists obtained without appropriate permissions

Where purchased or third-party lists are used, clients remain solely responsible for ensuring lawful use and compliance with applicable regulations.

Mailendy may refuse deployment of campaigns where list quality presents excessive risk to infrastructure or deliverability.


 

6. DATA PROTECTION

Clients must:

  • provide data lawfully

  • maintain appropriate permissions

  • respect privacy rights

  • comply with applicable data protection regulations

Clients may not use Mailendy services to process data obtained through unlawful means.


 

7. PLATFORM REPUTATION PROTECTION

Mailendy maintains communication infrastructure that depends on strong sender reputation and responsible communication practices.

Activities that may harm platform reputation include:

  • excessive complaint rates

  • excessive bounce rates

  • deceptive campaigns

  • poor-quality lists

  • abusive communication practices

Mailendy reserves the right to suspend or reject campaigns that may negatively impact service quality or infrastructure performance.


 

8. THIRD-PARTY SERVICES

Clients must comply with the policies of third-party services used in connection with Mailendy projects, including but not limited to:

  • Brevo

  • Mailchimp

  • Klaviyo

  • HubSpot

  • Google

  • Meta

  • WordPress

  • Hosting Providers

Violation of third-party platform policies may result in suspension of services.


 

9. CLIENT RESPONSIBILITY

Clients remain responsible for:

  • campaign content

  • audience selection

  • data quality

  • legal compliance

  • permissions and consent

  • communication accuracy

Mailendy provides systems, implementation, consulting, and operational support but does not assume responsibility for client-owned data or business activities.


 

10. INVESTIGATION & ENFORCEMENT

Mailendy reserves the right to investigate suspected violations of this policy.

Where a violation is identified, Mailendy may:

  • request corrective action

  • suspend campaigns

  • restrict account access

  • pause projects

  • terminate services

These actions may be taken without prior notice where necessary to protect infrastructure, clients, or legal compliance.


 

11. TERMINATION

Serious or repeated violations of this policy may result in:

  • immediate suspension

  • termination of services

  • removal of access

  • refusal of future services

Termination under this policy may occur without refund where violations have occurred.


 

12. CHANGES TO THIS POLICY

Mailendy may update this Acceptable Use Policy from time to time.

Updated versions will be published with a revised effective date.

Continued use of Mailendy services constitutes acceptance of any updated version.
